UPON hearing counsel the Court made the following
O R D E R
The ld. Advocate for the petitioner who is present
before the Court says that he is proxy counsel and he was
simply informed that process fee is paid and therefore, he is
unable to help the judicial process to see that how
respondents can be served at the earliest, when it was
inquired that who are unserved respondents and how to serve
them at the earliest.
The ld. Advocate, Ms Suchitra Hrargkhawl appearing on
behalf of Mr D Mahesh Babu, Advocate-on-record accepts notice
for the State-respondent no.1. Therefore, it is necessary to
verify by the petitioner that whether unserved respondent is

officer of the State or not. Unfortunately, the ld. Advocate
for the petitioner is unable to help the judicial process.
On verification it has been found that unserved
respondent No.2 is private party and probably original
complainant. It also reveals that complaint is pending
investigation and present litigation is for quashing the
complaint. In view of such fact, when petitioner is aware
about such details, it would be easy for the petitioner to
confirm service upon unserved respondent No.2 at least through
the Trial Court or through the Investigating Agency, where
some proceeding are pending.
Petitioner is permitted to confirm service by dasti
mode or through the Trial Court, being Metropolitan
Magistrate’s Court at Vijayawada.
Issue dasti notice if additional copies are supplied
before 7.1.2012, else list before the Hon’ble Judge in
Chambers for non-prosecution.
If notices are issued, list again on 21.2.2012.
Served respondents may file counter affidavit till
then.
