Let me explain the Speakasia in current scenario:

Mr. Tarak Bajpai and all other speakasia officials have been granted bail. But still Tarak sir taking treatment in hospital. On November 8 Mumbai High Court confirmed bail to all the accused in Raigarh issue. NOBODY IS UNDER COSTODY.

Guys, I think this is my first post in this Forum .. I have been like a spectator for so long but I wanna bring to ur notice that on 9/9/2011 there was a news article published in one of the Leading Marathi News Paper called as “Loksatta”… According to this News paper there were 2 Lawyers accepted a Bribe of 30 Lacs and tried to give to a Daughter of one of the Retired Magistrate … They tried to give Bribe to Give the Decision on their favor means against SAOL… This is a shocking News for me too … I do not know the authenticity of this news but just posting this coz I wanna show that there is someone very Strong who is working to tarnish the Image of our SAOL… Request you to stay calm and support our beloved company … Stay United We will surely WIN… Proud to be a Speak Asian …. Eventhough if it is true, it is not matter of worry because only one honest man in Judiciary system is enough to reveal the truth of SAOL !! Only the word WIN is there which is remain to write down on the WALL in the history and that is for sure !!!

These are applications for anticipatory bail by persons, who apprehend their arrest in Crime No.13 of 2011
registered at Mhasala Police Station. Learned counsel for the applicants at the outset states that without prejudice to the contentions and defences of the applicants, applicants are ready to deposit with the trial Court, a sum of Rs.18,89,000/- within a period of one week which has been mentioned by the learned Additional Sessions Judge, Mangaon, District: Raigad, an amount defalcated while rejecting the application for anticipatory bail. In fact the amount mentioned in the F.I.R. was Rs.1,53,000/- which according learned Additional Public Prosecutor, has now escalated to Rs.18,89,000/-. In view of readiness and willingness of the applicants to deposit the said sum before the trial Court, there should be no reason to subject the applicants to custodial interrogation. In view of this, applications are allowed. In the event of applicants' arrest in crime No.13 of 2011, registered at Mhasala Police Station, District Raigad, the applicants be released on bail on their furnishing P.R. bonds in the sum of Rs.50,000/- by each of them with one or more solvent sureties in the sums aggregating to Rs.50,000/- by each of them on the following conditions :- i) The applicants shall together deposit a sum of Rs. 18,89,000/- with the learned Judicial Magistrate First Class, Shrivardhan, District: Raigad, within a period of one week of this order, failing which the order shall stand revoked without reference to the Court. On depositing the said amount, the learned Magistrate shall invest the same in interest earning scheme in the State Bank of India, till decision of the trial and shall deal with the same at the end of the trial as per result of the trial. ii) The applicants shall make themselves available on 11th November, 2011 at 10.00 a.m. for interrogation by he Investigating Officer and thereafter as and when required by the Investigating Officer. iii) The applicants shall also furnish their mobile telephone numbers and addresses and other details to the investigating officer. iv) The applicants shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; v) The applicants shall not leave India without the previous permission of the trial Court. vi) The order shall remain in force till the trial is over with the only stipulation that if chargesheeted the applicant may furnish fresh bonds before the trial Court in view of the judgment of the Hon’ble Supreme Court in case of Siddharam Satlingappa Mhetre -vs- State of Maharashtra and ors, in S.L.P No.7615 of 2009. vii) All Applications are disposed of. Still SpeakAsia website is under EOW[11-11-11]
Dear SpeakAsians,
Over the last two days our website has all of a sudden become active and is allowing the SpeakAsians to log in and view the website. We would like to state that the website access passwords and database access was taken over by the Economic offences wing of the Mumbai Police. This was obtained from the technical team of the company that used to maintain the website. This action was executed immediately after the arrests of the company's COO and others. Since then SAOL has no access to the website speakasiaonline.com.
Furthermore, we would also like to clarify that the any attempt on our part to regain the server access would have been deemed as obstructing the investigation. SAOL is totally committed to cooperating with the concerned authorities and therefore has not initiated any action that may be deemed as obstruction to the investigations.
The motive behind partially restoring the access to the website speakasiaonline.com is at the moment not available to us as we have had no official communication from EOW, Mumbai Police on this subject.
We appeal to you to not believe false and motivated news item appearing online as well as in conventional media. We also would like to assure the SpeakAsian community that the company has initiated a series of actions aimed at restarting and returning to business as usual.

Friends Till date no Authority has Submitted any Report in Supreme Court……… :::: 8th November 2011 is not the date for us now :::: Next Hearing is Expected on 14th Nov 2011 Our Senior Council Mr. Mukul Rohatgi is out of India and will return on 10th Nov 2011 In his absence going for a New Advisor is not good because till date Sr Adv. Mukul Rohatgi has Handled the case in Perfect Manner. He only knows the past pleads in the court and aware of everything So Next Date will be after 10th November 2011 Only But may be our legal team tries to prepone it before 14th Nov As shown on Supreme Court Website …. ….This Update is for intelligent persons who understand the things…. Lessons from the 2G scam trial
These are indeed extraordinary times. How else should one interpret the order that's been delivered while denying bail to the likes of Kanmozhi and others. This was a case where the CBI itself had taken a position that it wasn't opposed to bail being granted to the DMK MP in the 2G scam case.
But the special sessions court Judge, Justice OP Saini, felt otherwise. The judge observed: "A murder may be committed in the heat of moment upon passion being aroused. An economic offence is committed with cool calculation and deliberate design with an eye on personal profit regardless of consequence to community. Rights of accused is important but rights of victims and witness is no less valuable..they should have a sense of safety and security. One way of generating a sense of security is to keep accused in custody till their evidence is complete."
Let's consider the profile of the accused. Kanimozhi is an MP from one of the most powerful political parties. If witnesses have to be influenced, it can easily be done by her family members. Karunanidhi may have lost power on his home turf but he remains an important force to reckon with at the Centre. Other bureaucrats like RK Chandaulia and Sidharth Behura have worked with the high and mighty in the corridors of power. They too can swing things without necessarily getting their own names involved.
So why this insistance on keeping the accused in custody till such time that the trial doesn't get over? Is this a case of judicial over reach? Isn't bail the fundamental right of an accused? Look at the US. One of India's biggest icons, Billionaire investment banker Rajat Gupta, has been declared guilty of insider trading. He faces a maximum punishment of 105 years in jail. He too is accused of committing an economic offence perhaps as grave if not bigger.
A case of cheating is just that, cheating! But he is out on bail. So can he not influence witnesses with his financial clout?
One can, of course, argue that there are several people who spend much more time in jail than even the sentence they would have served if they would have been declared guilty. Only because their trial continues. One can be accused of perhaps being soft on individuals who have committed the biggest fraud in corporate India. But the danger of what we are witnessing becoming a precedent for all times to come is just too big to be ignored.
There is the example of Speak Asia, a company that was involved in carrying out online surveys and polls to figure out consumer trends. This is a company which is running very successful and professional operations in several other countries. In India too, It managed to do good business and provide money to several middle class Indians. Till the time that someone decided to complain against them. Suddenly, everything that they had built had become illegal.
Its COO, A dynamic enterpreneur who used to be with the armed forces earlier, is in jail. Top executives of the company are allegedly on the run and the company's entire business operation is in jeopardy. The situation gets more curious as so far government agencies haven't yet produced any strong evidence against the company. Yet the company is finding the going tough.
So whether its Unitech, Reliance or Speak Asia, the complaint against all these big corporate players is the same, that they cheated. They are all supposed to be powerful enough to manipulate things in their favour. But then if that was indeed the case, How did they fail to manipulate the proceedings earlier? How did all of them land up in jail?
Need of the hour is for the criminal justice system to deliver verdicts quickly. Else India will soon lose its sheen of being the destination for entrepreneurship and growth.
EOW will file charge sheet in this month
According to source, the Supreme Court hearing postponed because EOW has completed their investigation and in this month they will file chargesheet. May be they waiting for EOW’s Final Report. So Supreme court hearing is postponed. EOW (Economic offence wing) have completed 90 days of Investigation and EOW will file charge sheet in this month
The charge-sheet is nothing but a final report of police officer under Section 173(2) of the Cr.P.C. . It is prepared by police after investigation and submitted to Court having jurisdiction. It can be altered by the court before framing the court charge.Till date no Authority has Submitted any Report

Friends,
We got one more update that Supreme court petition is postponed, before it was 8th November and now its postponed to 14th November. According to this source next hearing is 14th of November.
I understand that these are very testing times and it becomes very difficult to remain calm and patient. To proceed further maintaining our Unity and dignity is very very important. Definitely SAOL is going start but there is no fixed date for it. because it is in judical. We should happy that they till with us and fighting for us. Atleast they are trying to do something. Think once what about other company. SpeakAsia is also ready to pay if banks give permisssion. Time has come now to wait with patience and to hear good news. IT IS COMING SOON. Just few days left to regain the GLORY of being SPEAKASIAN. Please pray for Tarak Bajpayee, He is in bed rest and he had been transfer to some high facility hospital for ongoing surgery of heart.

Media is not bothered to report when the honorable supreme court of India give some positive relief to the Speak Asia community. Such a big news is not worth reporting. But of course it is worried about where Mr. Tarak Bajpayee is, whether he has reported to the court or not. And that is not a small news. It is such a big news that it finds place in the front page of Times of India. The standered of media has gone down so much that journalists are seen equivalent to criminals in our society. I am feeling really proud to call myself a Speak Asian because this time SAOL legal team didn't take it lightly. In SAOL's case it not only the Company which is fighting alone, but a strong community of 20 lakh Indians are also with the company. After such a long legal battle also people have not left the trust in company. We all are waiting eagerly for the hearing of the honorable supreme court on 8th November. On that date at least some relief should definitely come to the Speak Asians. All Indians know at least one thing that Indian judiciary is unbiased, brave and not at all affected by the opinion of malicious media of India. Lets fight together till we win . . .
